This is a point that will be looked-at, I think. No, it can't really be murder, which requires malice and forethought. We can certainly show the latter, but it's hard to show malice, even though this guy has no conscience of any kind. I doubt he cares about the dead at all -- one way or the other. He sees this in terms of personal threat to him.
But I would go with negligent homicide. That's fully provable. The best-guess of deaths that meet the definition is in the thousands, at least.
